Who can register a birth?
- Either parent if they are married to each other.- The 'Occupier' of the hospital where the birth took place.
- Any person having charge of the child.
- Any person present at the birth.
Many births are registered in hospital on Form
101 prior to the mother
leaving.
If the parents were not married at the time of the birth, recording the father's details on the birth certificate can be achieved in several ways depending on the circumstances.
If the mother is single and has never been married:
- Both parents should attend the Office of the Registrar to sign the register.
- The mother signs Form SC1 naming the father and the father acknowledges paternity by completing Form S.C.3.
- At the request of either parent in possession of a court order.
When the mother is married to someone else.
- The mother's husband declares that he is not the father.
- The mother declares that she has been living apart from her husband for a period of at least 10 months.
Where the mother's marriage ended more than 10 months prior to the birth.
- If a mother was widowed or divorced, a copy of the death certificate or divorce decree will be required.
Re-registering a birth
Unlike in the UK, a birth can be re-registered if:
- The parents were not married at the time of the birth but do so at a later time.
- The father's details were not registered initially, but the parents now wish to include these and can provide the documentation outlined above.
